CNN's Manveena Suri reports, "Only one hospital in northern Gaza is operational, the United Nations said, as Israeli strikes hammer areas near and at medical facilities, leaving medical workers fighting to keep patients, including premature babies, alive."

As the assault on Gaza continues, some look to the law. Selman Aksunger  (ANADOLU AGENCY) reports:

Lawyers for the Palestinian victims of Israeli attacks on Gaza filed a complaint Monday at the International Criminal Court (ICC) in the Dutch city of The Hague.

The victims’ representative before the ICC, Gilles Devers, and a four-person delegation that accompanied him submitted the complaint to the court’s prosecutor.

Addressing the press, Devers asserted that Israeli acts in Gaza constitute factors of the crime of genocide.

“The ICC is currently investigating the war crimes in a related investigation. The crime of genocide should also be included in this,” he said, adding that forcing over one million people to be displaced and cutting access to water, energy, food and medicine indicates that Israel wants total annihilation of the population in Gaza. 


The filing is something that many have called for around the world.  For example, Amy Goodman (DEMOCRACY NOW!) noted in yesterday's headlines:

Mary Lou McDonald, the head of Sinn Féin, is calling on Irish and European leaders to take action against Israel’s assault on Gaza.

Mary Lou McDonald: “Where is the protection of international law for every child killed in Gaza, for every Gazan mother holding the cold body of their dead child? Israel cannot be allowed to commit atrocities with impunity. The government says that Israel’s actions cannot be without consequences. I agree. That is why the Irish government must take the lead and refer Israel to the International Criminal Court and send the Israeli ambassador home.”

Mary Lou McDonald spoke at Sinn Féin’s annual conference, where Palestinian Ambassador to Ireland Dr. Jilan Wahba Abdalmajid also spoke and was met with a standing ovation.


But it's not just the Israeli government that's been named in a lawsuit.  In a US federal court Joe Biden, Antony Blinken and Lloyd Austin are named in one.  From the Center for Constitutional Rights:

November 13, 2023, San Francisco – Today, Palestinians asked a federal court to enjoin President Biden, Secretary of State Blinken, and Secretary of Defense Austin from providing further arms, money, and diplomatic support to Israel on grounds that there is an unfolding genocide by the State of Israel against the civilian population of Gaza and the U.S. officials have a legal duty to prevent, and not further, this most serious of crimes. 

Biden, Blinken, and Austin, as outlined in the complaint, are sued in their official capacity for failing to prevent an unfolding genocide where they have influence over the State of Israel to do so, and directly abetting its development with weapons, funds, and diplomatic cover, in breach of duties enshrined in the Genocide Convention and customary international law. The filing is accompanied by a declaration from the leading legal expert on genocide, William Schabas, who identifies features of the Israeli government’s statements, deadly military assault, and total siege as signs of genocide and affirms the United States’ breach of its legal duty to prevent genocide. A separate expert declaration by the genocide and Holocaust scholars Drs. John Cox, Victoria Sanford, and Barry Trachtenberg, explains how the genocidal intentions and actions of Israeli leadership resemble other genocides in recent history.

The complaint, which seeks declaratory and injunctive relief, cites the U.S. government’s unconditional support for Israel as it bombs the people of Gaza and deprives them of food, water, and other necessities. The complaint states that even the crimes committed by the military wing of Hamas on October 7th that killed an estimated 1,200 Israeli people, including many civilians, and kidnapped 240, cannot legally justify the forms of targeting an entire population and collective punishment meted out by the Israeli government, let alone genocide. Since October 8th, Israel has killed over 11,000 Palestinians in the Gaza Strip – mostly civilians, including more than 4,600 children – and displaced 1.5 million. Thousands of Palestinians remain missing, and Israel’s destruction of hospitals, schools, and most infrastructure in Gaza – as well as intentional deprivation of access to food, water, electricity, and medicine – has rendered life in Gaza impossible.

“To be honest, it’s difficult to revisit all the scenes of the past weeks. They open a door to hell when I recall them,” said Dr. Omar Al-Najjar, a 24-year-old intern physician at Nasser Medical Complex in Khan Yunis and a plaintiff in the case. “I’ve lost five relatives, treated too many children who are the sole survivors of their families, received the bodies of my fellow medical students and their families, and seen the hospital turn into a shelter for tens of thousands of people as we all run out of fuel, electricity, food, and water. The U.S. has to stop this genocide. Everyone in the world has to stop this.”

In addition to Dr. Al-Najjar, the other plaintiffs in the case are the Palestinian human rights organizations Defense for Children International–Palestine and Al-Haq; the individuals Ahmed Abu Artema, and Mohammed Ahmed Abu Rokbeh, who are in Gaza; and Mohammad Monadel Herzallah, Laila Elhaddad, Waeil Elbhassi, Basim Elkarra, and “A.N.”, who are U.S. citizens with family in Gaza. All have had multiple family members killed, subjected to the closure of Gaza, and displaced. 

Filed on the plaintiffs’ behalf by the Center for Constitutional Rights with the law firm of Van Der Hout, LLP, the complaint provides extensive evidence that the acts of the Israeli government represent an unfolding genocide, which the Genocide Convention defines as acts committed “with intent to destroy, in whole or in part, a national, ethnic, racial, or religious group,” and which can be accomplished through killing, inflicting serious bodily or mental harm upon a targeted group, or by “inflicting upon the group conditions of life calculated to bring about its physical destruction in whole or in part.” The Israeli military has targeted civilian areas and infrastructure, including using chemical weapons, and deprived Palestinians of basic necessities for life, the complaint says, while dehumanizing Palestinians as “human animals” that are undeserving of human rights protections and vowing to “eliminate everything,” making clear the “emphasis is on damage and not accuracy.” Gaza had already been subject to five prior bombing campaigns and a nearly 17-year military closure and ongoing occupation that had made Gaza an open air prison.

“For the last five weeks, President Biden and Secretaries Blinken and Austin have stood shoulder-to-shoulder with an Israeli government that has made clear its intention to destroy the Palestinian population in Gaza. As neighborhood after neighborhood, hospital after hospital, and sheltering displaced Palestinians were bombed, while subject to a total siege and closure that denies 2.2 million people basic necessities for life, they have continued to provide both military and political support for Israel’s unfolding genocidal campaign while imposing no red lines,”  said Katherine Gallagher, a senior attorney at the Center for Constitutional Rights and one of the lawyers who brought the case. “The United States has a clear and binding obligation to prevent, not further, genocide. They have failed in meeting their legal and moral duty to use their considerable power to end this horror. They must do so.”

The United States has a duty under Article 1 of the Genocide Convention to prevent and punish acts of genocide, an obligation the U.S. Congress made law in 1988 when it ratified the Convention and passed the Genocide Convention Implementation Act (18 U.S.C. § 1091). The duty to prevent is heightened given the United States’ considerable influence on Israel. The Biden administration, plaintiffs say, is not merely failing to prevent Israel’s genocide of Palestinians, it is actively abetting it. From the start of the bombing, Biden has repeatedly reaffirmed, through word and deed, “unwavering” U.S. support. 

Courts have identified the providing of weapons and other materials to the perpetrators of genocide as a form of complicity. To be culpable, the provider need not share the recipients’ genocidal intent.

William Schabas, the world’s leading legal expert on genocide, wrote in his declaration in the case, “I conclude that there is a serious risk of genocide committed against the Palestinian population of Gaza and that the United States of America is in breach of its obligation, under both the 1948 Genocide Convention to which it is a party as well as customary international law, to use its position of influence with the Government of Israel and to take the best measures within its power to prevent the crime taking place.”

“Palestinian children in Gaza are undoubtedly targets as repeated Israeli military offensives destroy their homes, schools, and neighborhoods, as Israeli forces use U.S.-made and funded weapons to kill them and their families with impunity,” said Khaled Quzmar, general director at Defense for Children International – Palestine. “While people protest in the streets, world leaders show, day after day, that they lack the temerity to end the catastrophic and unprecedented destruction of Palestinian life in Gaza. We need the American people to join us to force an end to this genocide.”

Local counsel Marc Van Der Hout of the law firm of Van Der Hout, LLP, said, “The United States must fulfill its obligations under the Genocide Convention and international law to prevent escalating atrocities in Gaza. The killings and kidnappings perpetrated by Hamas on Oct 7th, horrendous as they were, in no conceivable way justify the massacres now being perpetrated by the State of Israel with the unconditional support and acquiescence of the United States. The courts must now force the U.S. to comply with its obligations under the law.”  

“We have lost so many people, but there are still many more who are living, and we owe it to them to do everything possible to stop this genocide,” said Mohammad Herzallah, one of the plaintiffs in the case who has family in Gaza. “I have done everything in my power: I have participated in protests, sit-ins, wrote letters to my representatives, civil disobedience. Now I am asking the courts to end this ongoing genocide.”

Yesterday, Amy Goodman (DEMOCRACY NOW!) noted, "Israel is lashing out at the U.N. after Secretary-General António Guterres said it was guilty of 'clear violations of international humanitarian law' and that the October 7 Hamas attack in Israel 'did not happen in a vacuum.' The Israeli envoy to the U.N. demanded Guterres resign over the comments, as Israel has reportedly refused a visa to U.N. humanitarian affairs chief Martin Griffiths to 'teach them a lesson'."  It's not just about carrying out an assault on Gaza, it's about bullying and frightening anyone who might speak up.  



A New York University Law School student whose job offer from an international law firm was rescinded for remarks seen as insensitive to victims of the Hamas attack on Israel said they would continue to speak out.

Ryna Workman, who uses the pronouns they/them, told ABC News that speaking out was a matter of human rights.

"I will continue to speak up for Palestinian human rights and use whatever platform I have available to me to call for a ceasefire and end this occupation that's harming the Palestinians," Workman told ABC News Live Prime anchor Linsey Davis Tuesday in an exclusive interview.


And political hacks -- especially those who are unpopular -- will always try to ride a wave of censorship to score points.  Kathryn Varn (AXIOS) reports:


Gov. Ron DeSantis ordered Florida university officials to shut down their pro-Palestinian student groups.

Driving the news: State University System Chancellor Ray Rodrigues said Tuesday in a letter to university presidents that their chapters of Students for Justice in Palestine (SJP) "must be deactivated."


  • Only the University of South Florida in Tampa and the University of Florida in Gainesville have active chapters registered with the schools but the organization appears to have a presence at other universities, the Tampa Bay Times reports.

Details: Rodrigues' letter pointed to a "toolkit" released by the group's national chapter that said early October's Hamas attacks on Israel were part of "the resistance" and says: "Palestinian students in exile are PART of this movement, not in solidarity with this movement."

  • Rodrigues did not respond to Axios' request for comment.

The other side: The University of Florida SJP chapter told Axios in a statement that it found the "recent attempt by the DeSantis administration to shut down our chapter disgraceful."

  • "If followed through, a precedent would be set to shut down any organization that does not align with the ideals held by Governor DeSantis," the group added.


The assault on Gaza, which is not a war since only one side has the means to destroy a whole population, will cement what some in Washington wanted all along, more lies and more war. Now, speaking out for Palestine is conflated with supporting terrorism.
Another lie that spread like COVID-19 was that progressives and those on the left opposing war are empowering terrorists. Actually, terrorism thrives in war. Like a virus, it grows away from light and oxygen. Those who oppose war give the human family hope for curing a cancerous disease.

On 9/11, I was on my way to the White House to meet with President George W. Bush, and en route, I learned about the targeting of the Twin Towers and the Pentagon. Our meeting was canceled along with years of work for civic engagement, for getting moderate Muslim voices seen and heard, for resolving crises in the Middle East without war, for peacemaking among followers of the Abrahamic faiths, and for a future of America that included Islam.

Immediately after 9/11, the American people demonstrated their greatness by reaching out to Muslims and learning about Islam as a religion that created a great civilization, much like Western civilization. The Quran became a best-seller at bookstores. Muslims at every local level learned the art of public speaking and became spokespeople for the faith. They aspired to marginalize Osama bin Laden rather than be marginalized. But then the war drums began beating louder and louder, first Afghanistan and then Iraq, both strategic errors by the United States. We never learn from our mistakes.

We certainly don't appear to.  Ronald DeSantis thinks he can control free speech and dole it out only to those he agrees with.  That's frightening all by itself.  It's even more frightening and more upsetting when you grasp this piece of filth wants to be President of the United States and tip-toe on his tippy toes across the Constitution.

    Phyllis Bennis tells LAW AND DISORDER RADIO this morning, "I think what we're dealing with is a systemic level of oppression which has been going on, as you say, for 75 years. Actually, more than that, because colonization of historic Palestine began at the turn of the 20th century -- so even further than the 75 years ago when the state of Israel was created.  But from that time, in the war between Israeli settlers and Palestinian indigenous people in 1947, 1948, at the end of that war about 750,000 Palestinians -- a huge percentage of the entire population -- had been expelled from their homes.  They had been dispossessed of their homes, they had been driven out at gunpoint or frightened out with the threat of massacres that went on as part of the war. And many, many of the two million people who now live in Gaza are the descendents of those first refugees from what is now the state of Israel."  LAW AND DISORDER RADIO will begin airing this week's broadcast on its home station of WBAI this morning at 11:00 am EST -- and it airs on many other radio stations around the country throughout the week.

    Thomas S. Warrick is the liar and the paper wants you to know at the top of the piece: "Mr. Warrick is a nonresident senior fellow with Middle East programs at the Atlantic Council. He served in the U.S. State Department from 1997 to 2007."

    Oh, he sounds so harmless -- your first clue it's a lie.  If you can make it through all his lies and his endless stream of words you get a little more description at the end of the column

    Here's how Warrick described himself in a joint-piece for THE HILL just last month, "the other was the top career counterterrorism policy official at the Department of Homeland Security (DHS) for more than a decade. We served administrations of both parties."

    Doesn't see himself as a diplomat, nor should he judged by his words on what's taking place in Gaza.  He wants you to know -- mea culpa! -- mistakes were made by the US in Iraq after the fall of Baghdad!  He wants to save . . . someone.  

    Who?

    Apparently Israel.  He had a little plan for what Israel should do next.

    In his plan, the residents of Gaza are nothing more than play things.  They have no say.   They are not brought to the table.  

    But this is who THE TIMES (and the State Dept) thinks is worth listening to.

    They want you to believe the lie that peace is a coming and it's a coming from the Israeli government  and whatever the Israeli government decides to serve up, well the Palestinians jut have to f**kin' take it.

    The State Dept needs to find another mouth piece.  THE NEW YORK TIMES can't pull it off anymore.  THE TODAY SHOW could expand to 14 hours a day and it still wouldn't solve the problems at THE TIMES.  If this were the 80s, they'd dominate.  Not for circulation, never for circulation.  But for influence.  Back then, they called what ended up on the morning shows.  Bland host, "Today, THE NEW YORK TIMES is reporting . . ."  But the audience is gone for those programs now.  Getting three million viewers is now seen as 'amazing.'  And if TODAY did expand to 14 hours, let's all be honest, it would all be arts & crafts and lots of drinking.

    THE TIMES used to punch above its weight because its every utterance was magnified.  Its amplifiers are no longer influencers.

    Reading Warwick's column (no link to trash), he's refused to learn anything about Iraq.  Shouldn't have disbanded the Ba'ath party?  Yeah, I believe every significant witness at The Chilcot Inquiry made that point . . .  by the start of 2011.  

    It's more garbage from a garbage mouth that doesn't see the Palestinians as worthy of being included in crafting a future.

    On the front page of today’s New York Times website there is an editorial leading the Opinion section under the title, “Israel is fighting to defend a society that values human life.” An obvious question arises. What society is that? If you click through to the article itself a different title appears —“Israel Can Defend Itself and Uphold its Values.” Once again, an unintentional irony. But in fairness, you could argue that they are trying to appeal to people inside Israel who can be shamed.

    Today’s editorial probably shows that the Times editors are in a panic about just how far Israel will go, and they are trying to rein them in using a method they hope will work — flattery. There are, of course, Israelis who do not wish to commit a second Nakba, but those in charge — well, who wants to bet on that?

    In reality, Hamas attacked Israel and massacred 1,300 civilians, and Israel is responding with its own massive war crimes, which have already killed over 1,000 more civilians than Hamas did. And as detailed elsewhere on this site and even in the New York Times, it is committing war crimes. The Times is suggesting that Israel kill fewer people in a piece that whitewashes Israel’s record.     The “war of words” is as important as the battle itself.  Propaganda is used to rally the troops, manage public perceptions and garner support. The maxim that “in war, truth is the first casualty,” accurately renders the corporate media’s weighted coverage of the 7 October attack by Hamas against the Israeli occupier.

    Israel has firmly embedded the myth that it is a democratic, brave, vulnerable nation into the body politic of the United States.  In their current war against the Palestinians, Tel Aviv has made sure to control the narrative and to silence dissenting voices.  With the corporate media, they have established who matters, Israel, and who does not, the Palestinians.

    The first casualties of the disinformation campaign have been the use of the words “war” and “conflict.” Oxford English Dictionary defines war as “a state of armed conflict between different nations or states or different groups within a nation or state.”  Conflict is defined (dictionary.com) as a “struggle or clash between opposing forces.”

    It is a distortion to say that what we have witnessed in Palestine is a war or a conflict.  Both words imply a battle or struggle between equals or near equals, between two peoples with equal resources and claims.

    As Israel conducts its aggression against the Palestinians in Gaza, the media continues to improperly frame the killing of the colonized by the Israeli colonizer as a war and/or conflict.  CNN, MSNBC and National Public Radio, for example, have been using the promo, “Israel at War,” to entice viewers and listeners.

    Tel Aviv has declared war on a political party, Hamas.  The Gaza Strip—about the size of New Jersey— home to 2.3 million Palestinians, is not a nation or a state.  It has been under Israeli military occupation and blockade and can best be described as an open-air prison.  Until they were able to breach Israel’s high-tech security wall separating Gaza from Israel, Palestinian fighters were trapped behind it, making a land battle with the Israeli army impossible.  The sensor-equipped, 20-foot high steel and concrete wall with remote-controlled weapon and radar systems, cameras and underground sensors is an “iron wall” around Gaza.

    There is no symmetry between the overwhelming power of the Israeli war machine and Hamas.  Hamas has no sizable army (estimates at 40,000 fighters) no air force or navy.  It relies on missiles, drones and hand gliders.  Israel has the fourth largest army in the world (169,500 active duty and 360,000 reservists), a fleet of U.S.-made F-15, F-16 and F-35 fighter jets, 2,200 tanks, as well as sophisticated missile, drone and surveillance technology able to pinpoint and destroy individual targets.

    The language employed to describe Israel collides with logic, reason and history. The Palestinian people of Gaza and the occupied West Bank who have been resisting 75 years of land theft, colonization, murder, torture, imprisonment without due process, collective punishment, manipulation, humiliation and genocide are called militants” and terrorists.” In contrast, Israeli occupying forces are called defense” forces or commandos.
